# نداء مفتوح لوقف إطلاق النار في غزة ولبنان وإسرائيل ووضع حد للإفلات من العقاب في ظل الكارثة الإنسانية المتفاقمة والصراع الإقليمي المتصاعد

تناشد المنظمات الموقعة أدناه جميع الدول الأعضاء في الأمم المتحدة تأمين وقف فوري لإطلاق النار في غزة ولبنان وإسرائيل والمنطقة، والعمل على إنهاء الإفلات من العقاب الذي أتاح استمرار وتصاعد الفظائع التي ترتكبها القوات الإسرائيلية بحق المدنيين؛ فبدون المساءلة، لن تكون هناك خطوط حمراء أو نهاية للمأساة.

إن الحرب الإسرائيلية في غزة، في أعقاب الهجمات المميتة التي شنتها الجماعات المسلحة الفلسطينية في 7 أكتوبر 2023، تمثل أحدث وأفظع وأعنف هجمات الاحتلال الإسرائيلي المتواصلة منذ عقود على الأراضي الفلسطينية. وبعد عام من القتل والدمار الهائل، تتفاقم أنماط العنف المرتكبة بحق المدنيين على يد القوات الإسرائيلية، وتنتشر من غزة إلى لبنان، فيما تستمر الهجمات الصاروخية التي تشنها الجماعات المسلحة في لبنان.

نحن نقف حاليًا على حافة كارثة أكبر في جميع أنحاء المنطقة. والتخاذل عن التحرك الآن سيدفع لمزيد من للفشل في منع أو وقف الفظائع المستقبلية.

على مدار الأشهر الاثني عشر الماضية، أصدر مجلس الأمن أربعة قرارات بشأن غزة، بما في ذلك قرار يدعو لوقف إطلاق النار، كما أصدرت محكمة العدل الدولية أمرًا لإسرائيل باتخاذ جميع التدابير في حدود سلطتها لمنع ارتكاب جميع الأفعال التي تندرج ضمن نطاق المادة الثانية من اتفاقية الإبادة الجماعية. كما أصدرت محكمة العدل الدولية رأيًا استشاريًا [وجد](https://cihrs.org/open-call-for-a-ceasefire-in-gaza-lebanon-and-israel-and-end-to-impunity-amid-a-spiralling-humanitarian-catastrophe-and-escalating-regional-conflict/?lang=en) أن ضم الاحتلال الإسرائيلي للأراضي الفلسطينية غير قانوني، فيما أصدرت الجمعية العامة للأمم المتحدة قرارًا يطالب إسرائيل بإنهاء وجودها غير القانوني في الأرض الفلسطينية المحتلة في غضون 12 شهرًا. ورغم ذلك، لم يتم تنفيذ أي من هذه التدابير والقرارات أو الالتزام بها.

- تعليق نقل الأسلحة والقطع والذخيرة إلى أطراف النزاع التي قد تستخدمها لانتهاك القانون الإنساني الدولي.
- تمكين وصول المساعدات الإنسانية المنقذة للحياة دون عوائق، بما في ذلك الغذاء والإمدادات الطبية والوقود، وضمان التنقل الآمن للمدنيين والعاملين في المجال الإنساني.
- ضمان حماية المدنيين من المزيد من النزوح القسري، وحق العودة للمهجرين قسرًا، وضمان حماية المدنيين الذين يختارون البقاء أو غير قادرين على المغادرة، بموجب القانون الدولي.
- تأمين إطلاق سراح كل الرهائن والمعتقلين.
- الشروع فورًا في إجراء تحقيقات دولية مستقلة بشأن جميع الانتهاكات الجسيمة للقانون الإنساني الدولي وجرائم الحرب المرتكبة من جانب جميع الأطراف.
 
يتعين على الحكومات أن تبذل قصارى جهدها لإنهاء هذه الكارثة المتفاقمة ودائرة الإفلات من العقاب، ليس كضرورة أخلاقية فحسب، بل كالتزام قانوني. ويتعين على جميع الدول الأعضاء منع ارتكاب المزيد من الفظائع وضمان محاسبة المسئولين عن أي انتهاكات للقانون الدولي، بما في ذلك جرائم الحرب والجرائم ضد الإنسانية. إن الفشل في التحرك الآن يهدد بتآكل المعايير الدولية وتشجيع الجناة. ولابد من وقف دائرة العنف بحق المدنيين.
