نحن المنظمات والأفراد الموقعون أدناه، نمثل منظمات المجتمع المدني، والمنظمات غير الحكومية، وجمعيات الضحايا والناجين، والمؤسسات الأكاديمية من جميع أنحاء العالم. لدينا خبرات تقنية في مجال وقاية ومعاقبة الجرائم ضد الإنسانية، بما يشمل مقاضاة مرتكبيها أمام الهيئات القضائية والمحاكم الوطنية والدولية. كما أن العديد منا قد خاضوا تجربة مباشرة أو كانوا شهودًا على اقتراف جرائم ضد الإنسانية. نرحب بافتتاح اللجنة التحضيرية لمؤتمر المفوضين المعني باتفاقية منع الجرائم ضد الإنسانية والمعاقبة عليها، ونؤكد أنها خطوة حيوية نحو سد فجوة المساءلة القائمة منذ أمد طويل في القانون الدولي.
وفيما نثني على إدراج المنظمات غير الحكومية التي تتمتع بوضع استشاري لدى المجلس الاقتصادي والاجتماعي «ECOSOC» في اللجنة التحضيرية ومؤتمر المفوضين كمراقبين وفقًا للقرار 79/122؛[1] إلا أننا نبدي أسفنا لغياب نص صريح يضمن المشاركة المتساوية للمنظمات غير المعتمدة لدى المجلس الاقتصادي والاجتماعي (ECOSOC) والشخصيات ذات الخبرة والاختصاص في هذا المجال. وتعد مشاركتهم ضرورية لضمان قوة مسار المعاهدة ونتيجتها النهائية؛ إذ سيعمل توسيع نطاق المشاركة على تقوية تعددية الأصوات في قاعة الاجتماعات، بما يشمل الضحايا والفئات التي تفتقر عادة للتمثيل الكافي؛ وتعزيز نزاهة ومصداقية مسار وضع المعاهدة؛ وتيسير اعتماد مقاربة ترتكز على الضحايا والناجين، فضلًا عن مراعاة التداخلات الهيكلية والكفاءة النوعية في المعاهدة.
إننا نحث الدول الأعضاء على دعم المشاركة الكاملة والمجدية والآمنة للمجتمع المدني طوال فترة إعداد المعاهدة والتفاوض بشأنها، وفقًا للقانون الدولي وممارسات الأمم المتحدة وتوجيهاتها.[2] وهذا الأمر يستلزم إتاحة المشاركة الفعالة[3] للمنظمات ذات الصفة الاستشارية لدى المجلس الاقتصادي والاجتماعي، وضمان قدرة المنظمات والأفراد غير الحاصلين على هذا الاعتماد على المشاركة أيضًا، وبحقوق المشاركة نفسها الممنوحة لغيرهم. ومع الوضع في الاعتبار مبادئ الوضوح، والشمول، والتنوع، والتمثيل الجغرافي المتكافئ، والمناصفة بين الجنسين؛ فإن الوسائل المتاحة لمشاركة المجتمع المدني ينبغي أن تتضمن، على الأقل، تقديم مداخلات شفهية منفردة أو مشتركة، وبيانات مكتوبة ومستندات تُتاح لكافة المفوضين والمراقبين في مقر الانعقاد وعبر الشبكة، وميزات المشاركة الافتراضية والبث الحي، والمشاورات خلال الفترات الفاصلة بين الدورات. علاوة على ذلك، ينبغي بذل الجهود اللازمة لضمان وتسهيل المشاركة الواسعة للمجتمع المدني من خلال الحفاظ على المرونة في المواعيد النهائية للتسجيل والحصص المخصصة. إن هذه الوسائل لازمة بالنظر إلى العراقيل التي تعترض طريق المجتمع المدني في كثير من الأحيان، ومنها نقص الموارد، والقيود على السفر، وصعوبات التواصل والحركة وغيرها من معوقات الوصول، والتدابير الانتقامية من جانب الدول.
أثناء انعقاد الدورة الثمانين للجنة السادسة، أشارت أكثر من 50 دولة عضوًا إلى أن المجتمع المدني قد «أثرى بالفعل مسار [معاهدة الجرائم ضد الإنسانية] بخبرات لا تقدر بثمن»، بما في ذلك الدعوة ذاتها لإبرام معاهدة وفي «التحليل القانوني، والتوصيات العملية، والأفكار المبتكرة لمضمون وهيكل اتفاقية مستقبلية».[4]
إننا نحث الدول الأعضاء، على تيسير إجراءات شفافة وشاملة وفعالة لمشاركتنا المستمرة، تقديرًا لالتزامنا المشترك بمنع الجرائم ضد الإنسانية والمعاقبة عليها.
